
(RestoreAmericanGlory.com) – Ashley Moody, the Attorney General of Florida, led other GOP attorneys general to urge the Biden administration to fix what they have described as a catch-and-release “loophole” following the recent terror attack in Israel.
In a letter written by the group of attorneys general from 27 states sent to Alejandro Mayorkas, the Secretary of the Department of Homeland Security (DHS), the group called for the agency to implement regulatory changes that would resolve the loophole that the DHS has been exploiting in order to release migrants who enter the country through the Southwest border.
The petition to have U.S. Code 1225 updated to include rulemaking notes language that specifically states that all illegal migrants who had entered illegally through the border or had been presented at an entry point were going to end up detained if they were not found to be entitled to be allowed into the country.
The group has also alleged that since U.S. Code 1226, the DHS has been using language about foreign nationals either being detained or released. As he argued, the attorneys general have said that officials have been abusing that loophole in order to release more than 100,000 people in the United States in August alone.
They added that authority being used in such a way was completely unlawful and argued that the rule should also be applicable to those who are already in the country after crossing illegally through the southern border.
They added that it is not yet clear if there is a regulation that specifically provides authorization for 1226(a) and argued that the DHS needed to change its regulations to block the release of migrants in the country.
